Baker Burton & Lundy Trial Team Secures Complete Defense Verdict on Fraud Claims in 8-Day Fresno County Jury Trial

Baker Burton & Lundy, P.C. attorneys Albro Lundy and Rolando Gutierrez, together with Fresno local counsel John Migliazzo, secured a complete defense verdict for client Giumarra Brothers Fruit Co. following an 8-day jury trial in Giumarra Brothers Fruit Co. v. Cesar Mora, Fresno County Superior Court Case No. 23CECG03466.

The case centered on a proprietary fruit variety licensing agreement between Giumarra and one of its growers. In his cross-complaint, the defendant alleged that Giumarra had fraudulently induced him into the agreement through a series of false promises and misrepresentations. After an 8-day trial, the jury rejected every one of those claims, finding that Giumarra never made any of the alleged misrepresentations. The jury also found in Giumarra’s favor on its own breach of contract claim on the question of liability.
