Class Action Against Crossing, Inc. for Wage Violations

At Baker Burton & Lundy, P.C., we believe in fighting for the rights of employees who have been wronged by their employers. We recently filed a class action lawsuit against Crossing, Inc., its owner, Siliang Di, and related entities, on behalf of a group of employees who have been subjected to unfair and illegal wage practices. This lawsuit seeks justice for the workers who have been deprived of their rightful wages, meal breaks, and other basic rights under California law.

What Are We Alleging?

Our lawsuit includes a series of allegations based on California’s labor laws, including:

  1. Failure to Pay Minimum Wages: Under California law, employers are required to pay at least the state’s minimum wage for all hours worked. This lawsuit alleges that Crossing, Inc. failed to do so, shortchanging employees for their hard work.
  1. Failure to Pay Overtime and Double-Time Compensation: Many employees worked over 8 hours in a day and/or over 40 hours a week. Despite this, the lawsuit alleged that Crossing, Inc. failed to properly pay its employees overtime or double-time wages, as required by law.
  1. Failure to Provide Meal Periods: California labor law mandates a 30-minute meal break for employees who work more than five hours a day. Crossing, Inc. routinely failed to provide these breaks, instead requiring workers to continue their duties without proper rest.
  1. Failure to Provide Rest Periods: The law also requires a 10-minute rest break for every four hours worked. Again, Crossing, Inc. failed to comply, leading to exhausting workdays without the legally required breaks.
  1. Inaccurate Wage Statements: Employees are entitled to clear, itemized wage statements showing all hours worked and wages earned. Unfortunately, the wage statements provided by Crossing, Inc., were misleading, inaccurate, incomplete, and did not reflect the true hours or wages.
  1. Waiting Time Penalties: When employees leave a job or are discharged, they are entitled to receive all outstanding wages due. Crossing, Inc. failed to pay departing employees their final wages in a timely manner, resulting in additional penalties.
  1. Unfair Business Practices: These violations also fall under California’s Unfair Competition Law, which prohibits businesses from engaging in unlawful or fraudulent practices. By withholding proper wages and benefits, Crossing, Inc. gained an unfair advantage over its competitors while harming its employees.

Who is Affected?

This class action is filed on behalf of all current and former non-exempt employees who worked for Crossing, Inc., Crossing Media, Inc., Crossing Cards, Vernacular English, Inc., and/or Siliang Di, from October 24, 2020, to the present. These employees, many of whom worked behind the scenes managing live stream operations, inventory, and customer orders, were denied their legal rights.

Why Is This Important?

California has strong laws to protect workers, but these rights mean little if employers are allowed to violate them without consequence. Our lawsuit seeks to hold Crossing, Inc. and its owner accountable for their actions and ensure that every affected worker receives the compensation they are owed.
